1.2 You should read these Terms of Use carefully before using our Website, as by using our Website you are confirming that you accept these Terms of Use and that you will comply with them.
1.3 By accessing or using the Website, you confirm that you understand that the information on the Website: (a) is technical in nature, concerning medical and health economics and outcomes research and health technology assessment; and (b) is intended only for: (i) facilitating research and development in relation to medical and healthcare related policies; and (ii) medical and healthcare researchers, policy makers and other relevant stakeholders, including medical practitioners, pharmacists, and medical and para-medical staff of public and private hospitals or other accredited medical facilities and institutions involved in research relating to medical and health economics and outcomes, health technology assessment and development of medical and healthcare related policies (the “Target Users”). You also confirm that you are a Target User.
1.4 We may deny, suspend, restrict or terminate access to all or any part of the Website at any time if we reasonably believe that you are not a Target User, are using the Website otherwise than for facilitating non-profit research and development in relation to medical and healthcare related policies, or are otherwise in breach of these Terms of Use.
1.5 If you do not accept these Terms of Use you should leave our Website immediately.
1.6 The following policies also apply to your use of our Website:

4.2.2 use our Website to send or transmit, whether directly or indirectly, unsolicited or unauthorised advertising or promotional material, chain letters or pyramid selling schemes;
4.2.3 use our Website for mail bombing or flooding or to make deliberate attempts to overload a system;
4.2.4 use our Website to post content or link to content where you know that or ought to have known that the owner of that content has not consented to or authorised that posting or linking or where that posting or linking infringes the rights of that owner;
4.2.5 knowingly or recklessly introduce to our Website, or use our Website to transmit, any application, material or ware (such as viruses, spyware, malware or adware) which are malicious or harmful;
4.2.6 attempt to gain unauthorised access to our Website, the server, equipment or network on which our Website is stored, any server, computer or database connected to our Website or any software;

4.2.12 carry out a denial-of-service attack or a distributed denial-of-service attack on our Website or use our Website to carry out any such attack on any other Website;
4.2.13 interfere with, damage, disrupt, impair or compromise the operation, security, integrity or performance of the Website, or probe, scan or test the vulnerability of the Website or any related system or network;
4.2.14 use our Website:
4.2.14.1 for any purpose which; or
4.2.14.2 to send, transmit, publish, upload, download, use, store, reproduce or knowingly receive any material that
does not comply with the content standards set out in paragraph 7;
4.2.15 use our Website to groom, harm or take advantage of minors in any way or to attempt to do so; or
4.2.16 use our Website in violation of export laws, controls, regulations or sanction policies of Hong Kong or any other country.
4.3 If you breach any term of these Terms of Use your access to and use of our Website will immediately end. In addition we may take such other actions including, without limitation, legal action as we consider appropriate.
4.4 If you breach any term of these Terms of Use, or if we receive a request from a law enforcement authority to do so, we may report your identity, details of any breach and any other information we consider necessary to relevant law enforcement authorities.

5.5 The content on our Website is technical in nature, concerning medical and health economics and outcomes research and health technology assessment, and is intended only for: (a) facilitating research and development in relation to medical and healthcare related policies; and (b) Target Users. It is not directed to the general public. Although the information on the Website is provided in good faith, nothing on our Website constitutes medical advice, diagnosis, treatment advice, professional advice, investment advice, legal advice or any other advice on which you should rely, and we make no representation or warranty, express or implied, as to the accuracy, adequacy, validity, reliability, availability or completeness of any information on the Website. You should obtain appropriate specialist advice before taking, or refraining from taking, any action on the basis of any content on our Website.
5.6 We make no warranties, representations, undertakings or guarantees that our Website is secure or free from bugs or viruses. You are responsible for ensuring that the device from which you access our Website has suitable anti-virus software in place.

6.1 The Website is generally made available on a read-only basis and is not intended to permit users to upload, post or submit content for publication on the Website.

6.5 We are not responsible for, and make no warranties, representations, undertakings or guarantees in respect of, any material submitted by you or any other person through or in connection with the Website.
6.6 We reserve the right to remove, ignore, reject or disable access to any material submitted through or in connection with the Website at any time and we are not obliged to provide reason for taking any such action.
7. Content standards
7.1 If you submit any material to us through or in connection with the Website, you should do so only where requested or permitted by us and should consider carefully whether it is appropriate to do so.
7.2 Any material you submit to us through or in connection with the Website must:
7.2.1 comply with all applicable laws;
7.2.2 be accurate (where it states facts); and
7.2.3 be genuinely held (where it states opinions).

7.3.9 is made in breach of any legal duty owed to anyone else, such as a contractual duty or a duty of confidence or is content which is a trade secret where you are not the trade secret holder;
7.3.10 creates a risk to a person’s health or safety or public health or safety;
7.3.11 promotes or constitutes illegal or unlawful activity;
7.3.12 promotes any political activity;
7.3.13 compromises national security;
7.3.14 interferes with an investigation by a law enforcement or regulatory authority;
7.3.15 is threatening or abusive or invades another person’s privacy or causes annoyance, inconvenience or needless anxiety;
7.3.16 is likely to harass, upset, embarrass, alarm or annoy any other person;
7.3.17 impersonates any person or misrepresents your identity or affiliation with any person;
7.3.18 gives the impression it comes from us;
7.3.19 constitutes advertising material; or
7.3.20 advocates, promotes or assists any unlawful activity, including but not limited to copyright infringement or computer misuse.
8. Intellectual property rights
8.1 We, or our licensors, own all intellectual property rights in the Website and in all content, software, code, databases, compilations, designs, text, graphics, interfaces, audiovisual materials and other materials made available on or through it, other than content submitted by users or third parties where expressly identified.
8.2 “SCAN2030”, “SCAN-2030” and the associated names, logos, get-up, marks, trade names, brand assets and other indicia used on or in connection with the Website are our trade marks or brand assets (or those of our affiliates or licensors). Nothing in these Terms of Use grants you any right to use them, and you must not copy, reproduce, display, publish, distribute, communicate to the public, adapt, modify, incorporate into other materials or otherwise use any such names, logos, get-up, marks, trade names, brand assets or other indicia without our prior written permission.
8.3 Subject to your compliance with these Terms of Use, you may access and view the Website and may download or print reasonable extracts of content from the Website solely for your own lawful, internal, non-commercial and non-profit research, educational or policy-development purposes as a Target User. This limited permission is for personal reference only and does not permit any external, public-facing, promotional, publication, presentation, exhibition, event, social media, website, media, press, commercial or other dissemination or exploitation of any content, data, materials, screenshots, outputs, logos, brand assets or other intellectual property from or relating to the Website without our prior written permission.
8.4 Without limiting the foregoing, all databases, datasets, data compilations, data structures, taxonomies, tables, indexes, search results, metadata and other data or database content made available on or through the Website (including the Innovative Medicine Database) are protected by copyright, database rights (where applicable), trade secrets, contractual restrictions and/or other intellectual property or proprietary rights.
8.5 You may not access, use, extract, reuse, reproduce, republish, distribute, communicate, disclose, sell, license, rent, lease, transfer, make available, combine with other materials, create derivative works from, or otherwise exploit any substantial part of any database, dataset or data compilation made available on or through the Website, whether by manual or automated means, except to the limited extent strictly necessary for your own lawful, internal, non-commercial and non-profit research, educational or policy-development purposes as a Target User and in each case subject to these Terms of Use. For the avoidance of doubt, you must not use, reproduce, publish, disclose, distribute, communicate to the public, make available, display, incorporate or otherwise exploit any database, dataset, data compilation, table, index, search result, metadata, output or other data or database content from the Website in any conference presentation, academic or other publication, website, social media post, exhibition, public event, press or media material, marketing or promotional material, or any other public-facing activity without our prior written permission.
8.6 Without our prior written permission, you must not copy, reproduce, download, capture, screenshot, record, scrape, extract, publish, republish, display, distribute, communicate to the public, make available, adapt, modify, incorporate into other materials, create derivative works from, or otherwise use or exploit any Website content, materials, data, outputs, screenshots, screen captures, visual displays, logos, brand assets, trade marks, trade names, get-up or other intellectual property from or relating to the Website in any conference presentation, academic or other publication, website, social media post, exhibition, public event, press or media material, marketing or promotional material, or any other public-facing activity.
8.7 Without our prior written permission, you must not systematically download, copy, scrape, mirror, cache, harvest or extract data or other content from the Website to create or contribute to any separate database, dataset, repository or information service, whether commercial or non-commercial, or use any such data or content for training, testing, validation or benchmarking any algorithmic, statistical or artificial intelligence model or system.

8.10 If you use, download, print, reproduce, publish, distribute, communicate, make available, display or otherwise exploit any content, materials, data, database content, screenshots, logos, brand assets or other intellectual property from or relating to our Website in breach of these Terms of Use, your access and use of our Website will immediately end and you must return to us or destroy (at our option) all digital and paper copies of the relevant materials that you have made.
8.11 Nothing in these Terms of Use is intended to restrict any use of the Website or any content on it to the extent that such use is expressly permitted by applicable laws and cannot lawfully be excluded or restricted by contract. However, you remain responsible for ensuring that any such use complies with all applicable laws and does not exceed what is legally permitted.
